In accordance with the City of Clearwater’s Citizen Participation Plan and the requirements of the U.S. Department of Housing and Urban Development (HUD), two public hearings are being held to provide the public an opportunity to comment on a substantial amendment to the 2021/2022 Annual Action Plan. The proposed substantial amendment is outlined below:

The City of Clearwater is proposing to amend the 2021/2022 Annual Action Plan to reallocate HOME Investment Partnerships Program American Rescue Plan (HOME-ARP) funding. The reallocation will move funds from Supportive Services and Tenant-Based Rental Assistance (TBRA) to Affordable Rental Housing.

The reallocation is intended to increase housing stability by expanding the affordable rental housing stock within the city for individuals and/or families in the specified “qualifying populations” described in HOME-ARP. The total amount of available HOME-ARP funds is $1,637,567. The proposed amendment will reprogram this funding from and to the following projects:

PROPOSED PROGRAM YEAR 2024 ANNUAL ACTION PLAN

30-DAY PUBLIC COMMENT PERIOD & PUBLIC HEARINGS

The City of Clearwater is hereby publishing the proposed Annual Action Plan (AAP) for Federal Fiscal Year (FY) 2024 to allocate federal funding from the Community Development Block Grant Program (CDBG) and HOME Investment Partnerships Program (HOME) under the U.S. Department of Housing and Urban Development (HUD). The AAP identifies projects and activities to be implemented by the City during FY 2024, which begins on October 1, 2024, and ends on September 30, 2025. In addition to the entitlement grant, funding allocations also include anticipated program income generated by the City’s Revolving Loan Fund as well as prior-year (i.e., carryover) resources from projects that were either cancelled or completed under budget to be applied toward new projects. CDBG funds are used to provide decent housing, suitable living environments, and economic opportunities to principally benefit low- and moderate-income persons. HOME funds are used to foster private sector partnerships with for-profit and non-profit organizations to develop affordable housing.

The City of Clearwater anticipates an estimated $940,482 in new CDBG funds, $1,310,415 in CDBG program income, and $367,097 in prior-year CDBG resources. The City also anticipates an estimated $400,222 in new HOME funds, $1,706,038 in HOME program income, and $2,791,413 in prior-year HOME resources. These funds will be programmed to eligible activities under these grant programs.

The list below captures all proposed projects to be funded with CDBG and HOME resources in FY 2024. Funding for these and other projects are estimated resources only and funding amounts may increase or decrease based upon actual program income, prior-year adjustments, and/or final federal funding allocations. Due to these and other factors, the City of Clearwater reserves the right to add or delete projects and/or adjust funding allocations proportionally.

The Department of Environmental Protection hereby provides notice that it has prepared a draft permit for the proposed project as detailed in the application, subject to the conditions specified in the draft permit and summarized below. The applicant, City of Clearwater Public Utilities, Richard Gardner, PE, Public Utilities Director, 1650 North Arcturas Avenue, Clearwater, Florida 33765 applied on Jun 8, 2023, for a Class I injection well construction permit. The project is located at Northeast Water Reclamation Facility, 3290 State Road 580, Clearwater, Florida 34695, in Pinellas County (File 0348911-002-UC/1X, WACS ID 103169).

The permittee will construct and operationally test one non-hazardous Class I well (IW-1) and associated monitor wells (MWUZ-1 and LWUZ-1) for the disposal of reverse osmosis concentrate derived from the Groundwater Replenishment Advanced Water Purification Plant at the City of Clearwater Northeast Water Reclamation Facility (WRF). The maximum injection rate for IW-1 shall be 1,500 gallons per minute and the maximum injection volume for IW-1 shall be 2.16 million gallons per day. The injection well will be constructed with an 18-inch diameter steel casing set to 720 feet below land surface (bls), a 9.675-inch diameter fiberglass-reinforced plastic tubing set to 715 feet bls with a cemented annulus, and total depth of 1,100 feet bls. Two single-zone monitor wells (MWUZ-1 and MWLZ-1) will be completed in the Upper Floridan aquifer from 350 to 390 feet bls and from 460 to 500 feet bls respectively.

The Department has permitting jurisdiction under Chapter 403 of the Florida Statutes and the rules adopted thereunder. The project is not exempt from permitting procedures. The Department has determined that an Underground Injection Control permit is required for the proposed work.

Any interested person may submit written comments on the draft permit and may request a public meeting within 30 days after publication of this public notice. A request for a public meeting shall be submitted in writing and shall state the nature of the issues proposed to be raised in the meeting. If a public meeting is later scheduled, there will be another 30-day notice period for that meeting. Written comments or a public meeting request shall be submitted to the Department of Environmental Protection, Aquifer Protection Program, 2600 Blair Stone Road, MS 3530, Tallahassee, Florida 32399-2400, which is the office processing this permit application. All comments received within the 30-day period will be considered in formulation of the Department's final decision regarding permit issuance.

TA2024-08003 - Proposed Ordinance 9791-24 revises the definition of artwork to clarify what constitutes signage within artwork. This Ordinance also proposes to increase the allowable sign area for window signs in the Downtown District. Currently, Community Development Code Section C-705 sets forth the allowable sign area, number, and types of signs. Table 6 specifies that 10% of window signage on each first-floor window and glass door opening is permitted. The proposed revision would allow window signs to equal 25% of each first-floor window or window grouping.

    These ordinances propose to annex a residential property into the city of Clearwater, which will promote public health, safety, and welfare by allowing for public utilities and emergency services to be provided by the city to the property.

    1. An estimate of direct compliance costs that businesses may reasonably incur;

Business Impact Estimate

This form must be posted on the city’s website by the time notice of the proposed ordinance is published for public hearing.

The following Business Impact Estimate is hereby provided for the following ordinance in accordance with Section 166.041(4), Florida Statutes and represents the City of Clearwater’s good faith estimate of the business impact of said ordinance.

Note: Business Impact Estimates are not required for the following types of ordinances:

1. Ordinances required for compliance with federal or state law or regulation;

2. Ordinances relating to the issuance or refinancing of debt;

3. Ordinances relating to the adoption of budgets or budget amendments, including revenue sources necessary to fund the budget;

2. Summary of the proposed ordinance (must include a statement of the public purpose, such as serving the public health, safety, morals, and welfare):

This ordinance establishes standards for the installation of artificial turf within the city’s landscape code, including: where it can be installed; design / material standards; permitting via building permit which can be applied for by a contractor, professional installer, or homeowner; installation standards, such as those that must be met for artificial turf to be treated as pervious, and how tree preservation will be handled; maintenance requirements; and how existing artificial turf installation will be handled (allowed to stay). The city’s Community Development Code is a redevelopment code, and beautification of the city is a high priority, as is the preservation of natural resources and the aesthetic character of the community for both the resident and tourist populations.

3. An estimate of the direct economic impact of the proposed ordinance on private, for-profit business in the City of Clearwater, if any:

a. An estimate of direct compliance costs that businesses may reasonably incur;

Outside of the cost for the materials and installation in a code-compliant manner, direct costs include the payment of an artificial turf permit fee (new) and a right-of-way permit fee (existing), applicable if artificial turf is proposed to be installed within the right-of-way. Businesses who wish to install artificial turf are anticipated to primarily use professional installers or contractors, but this is not a cost incurred only because of this ordinance.

b. Any new charge or fee imposed by the proposed ordinance or for which businesses will be financially responsible for; and

The proposed artificial turf permit fee is $200.00. Current right-of-way permit fees are $25.00 for residential properties and $125.00 for commercial properties.

c. An estimate of the City of Clearwater’s regulatory costs, including estimated revenues from any new charges or fees to cover such costs.

The city does not project that this new regulation will generate revenue, as that is not the intent for this ordinance change. The proposed artificial turf permit fee is expected to cover staff review time, which will involve representatives from land resources (arborists), engineering and zoning, as well as final inspection to confirm proper installation. Support staff, including permit technicians, will assist with permit processing.

To ensure artificial turf is being maintained properly or is brought into compliance, code inspector time may be needed in the long term; however, this will be addressed by the existing staff as part of their daily work.

4. Good faith estimate of the number of businesses likely to be impacted by the proposed ordinances:

An estimated 5-10 businesses in the first year may apply to install artificial turf, with others in upcoming years.

5. Additional information the governing body deems useful (is any):

This ordinance was developed with the assistance of persons in the artificial turf industry. Additionally, city staff researched what other jurisdictions currently require as a foundation for certain proposed standards. Staff also gained insights from those regarding what they might seek to modify if given the opportunity so that their requirements functioned better for all parties (city and property owners). This ordinance is intended to provide clear standards without creating an undue burden of process. This is captured in the proposed approach to permitting, installation, and inspections.

The City of Clearwater is currently preparing its Annual Action Plan, which involves selecting funding applications for public service programs and public facility projects. A technical review committee (TRC) will meet to evaluate and score these applications. The City will hold two virtual, public TRC meetings to gather input and help prioritize applications that may qualify for federal funding through the Community Development Block Grant (CDBG) program, administered by the U.S. Department of Housing and Urban Development (HUD). This federal program aims to benefit low- to moderate-income residents.
